1. Acceptance of Terms

By accessing or using the examupdt website, mobile application, or any of our services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you ("User") and examupdt Education Private Limited ("examupdt", "we", "us").

2. Description of Services

examupdt provides study abroad consultancy services including, but not limited to:

• University shortlisting and application support.
• Statement of Purpose (SOP) and essay writing guidance.
• Standardised test preparation (IELTS, TOEFL, GRE, GMAT, PTE, SAT).
• Student visa application assistance and interview coaching.
• Scholarship identification and application support.
• Pre-departure orientation and post-arrival guidance.

examupdt acts as a facilitating consultant. We do not guarantee admission to any university or approval of any visa application, as these decisions rest solely with the respective institutions and government authorities.

3. User Eligibility

To use our Services, you must:

• Be at least 16 years of age (or 18 in certain jurisdictions).
• Provide accurate, complete, and current information during registration and throughout service delivery.
• Not be prohibited from receiving services under applicable law.

We reserve the right to refuse service to anyone at our sole discretion.

4. User Obligations

By using our Services, you agree to:

• Provide truthful and accurate information about your academic background, qualifications, and finances.
• Submit all required documents in a timely manner as requested by our counselors.
• Not misuse, reverse-engineer, or attempt to gain unauthorised access to our platform.
• Not use our Services for any unlawful, fraudulent, or harmful purpose.
• Keep your login credentials confidential and notify us immediately of any unauthorised account access.

Providing false or misleading information may result in immediate termination of services without refund.

5. Fees and Payments

Service fees are communicated transparently before engagement and must be agreed upon in writing. Key payment terms include:

• Fees are denominated in Indian Rupees (INR) unless otherwise specified in your service agreement.
• Payment plans are available for qualifying service packages, subject to separate agreement.
• All fees are exclusive of applicable taxes (GST), which will be added at the time of invoicing.
• University application fees, visa fees, and test registration fees are separate and payable directly by the student to the respective bodies.

6. Refund Policy

Our refund policy is designed to be fair and transparent:

• Within 7 days of payment: Full refund if no counselling session has been conducted.
• After first session: 50% refund, minus the cost of services already rendered.
• After application submission: No refund is applicable once university applications have been filed on your behalf.
• Visa Refusal: examupdt is not liable for visa rejections made by immigration authorities. Service fees are non-refundable in such cases, as the consulting service was duly rendered.

7. Intellectual Property

All content on the examupdt platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the exclusive property of examupdt and is protected by applicable Indian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content without prior written consent from examupdt.

SOPs, essays, and documents drafted with assistance from our counselors are prepared for your personal academic use only and may not be resold or shared.

8. Limitation of Liability

To the fullest extent permitted by applicable law, examupdt shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of admission, scholarship, visa, or any other opportunity arising from decisions made by universities or government bodies.
• Errors, inaccuracies, or outdated information on third-party university or government portals.
• Service interruptions caused by technical issues, force majeure, or events beyond our reasonable control.

Our total liability in connection with any claim shall not exceed the total fees paid by you for the specific service in question.

9. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through mutual negotiation within 30 days of written notice.

If unresolved, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Karimnagar, Telangana, India.
